Conditions
General Contract and Travel Conditions (GCTC) of Adventurea Travel Boutique
These General Contract and Travel Conditions (GCTC) are part of the travel contract between the customer and Adventurea Travel Boutique. The rights and obligations of the customer and Adventurea Travel Boutique are derived from the individual written agreement, from these GCTC, and from statutory provisions.
Contract Conclusion
1.1. Formation of the Contract
Descriptions of services published by Adventurea Travel Boutique (e.g., on the Internet or in travel brochures) are to be understood as an invitation to offer. The customer's booking can be made in person, by phone, in writing, or via the Internet. With the booking, the customer submits a binding offer to Adventurea Travel Boutique for the conclusion of a travel contract. The travel contract is concluded when Adventurea Travel Boutique accepts the booking.
1.2. Mediation of Services
In the mere mediation of services by third parties, the contract is concluded between you and the third-party company. In such cases, Adventurea Travel Boutique is not a contractual party and these GCTC do not apply.
2. Obligation to Cooperate (Passport/ID/Visa/Vaccinations)
In addition to the timely payment of the travel price, the following cooperation obligations exist for you:
-
You must check the documents sent to you (invoice, confirmation, documents, etc.) for accuracy and completeness, especially for consistency with the booking and correct and complete spelling of the names of all travelers according to passport and/or ID, and inform Adventurea Travel Boutique immediately of any discrepancies.
-
You are responsible for complying with entry requirements for all travelers, especially regarding required travel documents and their validity, obtaining visas, and compliance with health regulations, or timely vaccinations.
-
Minors under 18 years traveling without a legal guardian or with only one parent must carry a certified letter of authorization from the absent parent(s). Failure to comply with these obligations releases Adventurea Travel Boutique from any liability, and no compensation or refund claims will arise.
3. Prices
3.1. Price Determination
The travel price is primarily determined by the information communicated in writing by Adventurea Travel Boutique (e.g., via email, travel confirmation, invoice) and secondarily according to the prices published in Adventurea Travel Boutique's general publications. Unless otherwise stated, prices are per person in Swiss Francs, including VAT in the respective accommodation. The prices valid at the time of booking apply. A surcharge may be levied for adjustments to the published prices, such as individual stays. Booking fees for processing and reservation as well as any additional costs such as visa fees or tourist taxes, which may also be levied locally, are reserved.
3.2. Payment Terms
For the trip, a deposit of usually 30% of the invoice amount and the premium for the booked insurance services are due and must be paid immediately to the booking office. The remaining payment must be made no later than 30 days before departure. In special cases (e.g., certain scheduled flights, bookings within 30 days before departure, services with up to 100% cancellation costs), the entire amount is due upon order. Failure to make timely payments entitles us to cancel the reservation or deny travel services.
3.3. Travel Documents
You will receive travel documents after receipt of the full payment no later than 10 days before departure. For last-minute bookings, the travel documents may be deposited at our airport representative if we cannot send them to you electronically.
3.4. Price Changes
Adventurea Travel Boutique reserves the right to increase the travel price after the conclusion of the contract accordingly, especially in the case of:
-
Subsequent price increases by transport companies (e.g., fuel surcharges)
-
Newly introduced or increased government charges or fees (e.g., increased airport taxes)
-
Exchange rate changes
-
Invoicing and publication errors
-
Small group surcharges
Price increases can be claimed up to 21 days before the planned start of the journey. If the price increase is more than 10% of the travel price, you are entitled to withdraw from the contract within 3 days of receiving the notification, free of charge, or to rebook to another trip offered by us without any processing fees. Any payments already made or differences will be refunded to you as quickly as possible without any deductions.
Cancellation/Change of Trip
4.1. Notification
If you cannot undertake the trip, you must inform your booking office immediately—on request, also in writing, stating the reason. The cancellation can only be processed during office hours. Therefore, the date of processing by or your booking office is decisive for the calculation of the cancellation fees.
4.2. Processing Fees for Change/Rebooking
For name changes (e.g., incorrect spelling), we will charge you a processing fee of up to CHF 100.–. For changes to the travel date, destination, place of departure, or accommodation after the conclusion of the contract, we will charge a processing fee of CHF 100.– per order. The same changes within the cancellation periods according to Section 4.4 also incur cancellation costs.
4.3. Substitute Person
Provided that the companies or service providers involved accept a substitute person and no governmental orders, legal regulations, or tariff provisions conflict, the entry of a substitute person is permitted under the same conditions. In addition to the substitute person, you are personally liable for the payment of the travel price and any fees.
4.4. Cancellation Fees
If you cancel the booked trip entirely or partially, regardless of the timing, we will charge a processing fee of CHF 100.– per order. This processing fee is waived for cancellations with 100% cancellation costs. In addition to the processing fees, the following cancellation costs apply as a percentage of the total arrangement price (including airport taxes, meal surcharges, etc.):
-
Up to 30 days before departure: 30%
-
29 to 1 day(s) before departure: 80%
-
On the day of departure: 100%
4.5. Non-Appearance for the Trip
In the event that the journey is not commenced without prior cancellation, or if the departure is missed due to late arrival or due to insufficient travel documents, there is no entitlement to a refund. In such cases, we will charge 100% of the arrangement price.
4.6. Termination of the Journey
If you terminate your journey prematurely for any reason, you are not entitled to a refund of the travel price or unutilized services.
5. Termination/Changes by Adventurea Travel Boutique
5.1. Material fallacy
In the case of a material fallacy during contract conclusion, particularly with calculation and/or publication errors concerning the travel price, Adventurea Travel Boutique is entitled to withdraw from the contract. In this case, you are entitled to a full refund of any payments made.
5.2. Program Changes
It may occur that after the conclusion of the contract, the travel program or individual agreed-upon services such as accommodation, means of transport, airlines, or flight times have to be changed due to force majeure, unforeseeable or unavoidable circumstances. In this case, we will strive to offer you a substitute service that is, according to objective viewpoints, at least equivalent.
5.3. Minimum Participation/Small Group Surcharge
Certain trips, especially round trips, have a minimum participation requirement. If this minimum number of participants is not reached, the trip may either not be carried out or may be carried out with a small group surcharge. If a trip has insufficient participants or if special circumstances force us to make significant changes to the offered services before departure, we can cancel the trip up to 21 days before the agreed travel date. In both cases, we will strive to offer you an equivalent alternative program. If the substitute program is cheaper, we will refund the price difference; if it's more expensive, we will charge you the additional costs. If no substitute program is possible or you decline it, we will refund any payments already made. Further compensation claims are excluded.
5.4. Force Majeure and Strikes
If there are reasons making the execution of a trip impossible, such as force majeure, war, unrest, strikes, regulatory actions, revocation or denial of landing rights, or circumstances that, in our view, could endanger life and health, Adventurea Travel Boutique can withdraw from the contract at short notice. Should the trip or stay be terminated for the above reasons, we will strive to bring the participants back to another holiday area or to Switzerland as quickly as possible. We are entitled to deduct any verifiably incurred expenses from the refund of your payment. Further claims for compensation are excluded.
6. Liability
6.1. General
Adventurea Travel Boutique, as the organizer, is liable for the proper execution of the travel arrangement. We will compensate you for the loss of agreed services or your additional expenses if it was not possible to offer you an equivalent substitute service on-site and no fault of your own exists. However, our liability is limited to the amount of the travel price and only covers direct damage. Any further liability is excluded to the extent permitted by law. No liability is accepted for program changes due to flight delays or strikes. Specifically, Adventurea Travel Boutique is not liable for changes in the travel program (cancellations, delays, etc.) that are due to force majeure, regulatory actions, delays by third parties, and in cases according to Art.
6.2 Personal Injury
Adventurea Travel Boutique is liable for personal injuries resulting from culpable non-fulfillment or improper fulfillment of the travel arrangements by Adventurea Travel Boutique or a company commissioned by Adventurea Travel Boutique (hotels, airlines, etc.), under the condition that you assign your claims for damages to Adventurea Travel Boutique. In cases of liability related to air travel or the use of other transportation companies, the compensation claims are limited to the amounts stipulated by applicable international agreements or national laws. These claims must be made directly to the respective transport company. Any further liability of Adventurea Travel Boutique is excluded.
6.3 Property Damage
Adventurea Travel Boutique is liable for damage resulting from theft or damage of goods if culpably caused by Adventurea Travel Boutique or a company commissioned by Adventurea Travel Boutique, provided you do not receive compensation elsewhere (e.g., from your insurance) and you assign your claims to Adventurea Travel Boutique. The compensation, however, is limited to the direct damage, up to the amount of the travel price for the affected person. In cases of liability related to air travel or the use of other transportation companies, the compensation claims are limited to the amounts stipulated by applicable international agreements or national laws. Any further liability is excluded.
6.4 Local Activities/Services
Local events, excursions, and other services can be booked at the travel destination. Such activities may carry specific risks or require physical prerequisites. You book such activities at your own risk. We decline any liability for such services unless we or our local representatives are explicitly responsible as service providers.
6.5 Travel Advisories
The Federal Department of Foreign Affairs (EDA) regularly publishes information on countries with potential security or other elevated risks. We assume you have informed yourself of these travel advisories before commencing your journey.
7. Insurance
We strongly recommend that you purchase cancellation insurance with SOS protection for travel incidents when booking unless you already have sufficient coverage. Adventurea Travel Boutique can facilitate such insurances.
8. Data Protection
Our privacy policy governs the processing of personal data in connection with these Terms and Conditions.
9. Jurisdiction and Applicable Law
In the relationship between you and Adventurea Travel Boutique, Swiss law is exclusively applicable. The court of jurisdiction is Uster, subject to mandatory legal provisions.
